These Terms of Service ("Terms") govern your access to and use of the SwapNaija platform, website (swapnaija.com), and OTC desk exchange services. By initiating an exchange or accessing our services, you agree to be bound by these Terms.

1. Exchange Services

SwapNaija operates as an over-the-counter (OTC) matching and facilitation platform for digital assets, including cryptocurrencies (such as USDT, Bitcoin, Ethereum, Solana) and recognized gift cards. We provide live exchange quotes, trade fulfillment, and direct Naira bank transfers. SwapNaija is not a depository bank or financial broker.

2. Eligibility and Identity Verification

You must be at least 18 years of age or the legal age of majority in your jurisdiction to use SwapNaija. To prevent fraud, money laundering, and illegal activities, we reserve the right to request proof of identity or trade ownership before fulfilling any transaction.

3. Rates, Quotes & Settlement

All exchange transactions are executed at the specific rate confirmed directly with our verified desk at the moment of trade agreement. Due to volatility in cryptocurrency and OTC gift card markets, rate quotes are time-sensitive. Payouts are executed in Nigerian Naira (NGN) directly into the valid domestic bank account provided by the user.

4. Risk Disclosure

Digital asset trading carries inherent risks including market fluctuations, blockchain confirmation delays, and price volatility. By transacting with SwapNaija, you acknowledge these risks and agree that SwapNaija is not responsible for market losses or incorrect blockchain addresses supplied by the client.

5. Prohibited Activities

You agree not to use SwapNaija for fraudulent activities, stolen gift cards, proceeds of cybercrime, or any violation of Nigerian and international financial laws. Any suspected fraudulent trade will result in immediate cancellation, blacklisting, and reporting to legal enforcement authorities.

6. Refunds and Cancellations

Because digital asset transfers and gift card redemptions are irreversible once processed, completed transactions cannot be cancelled or reversed. If an inquiry or dispute arises prior to payout, contact support@swapnaija.com immediately.

7. Limitation of Liability

To the fullest extent permitted by law, SwapNaija, its founders, and desk representatives shall not be liable for indirect, incidental, or consequential damages. Our total liability for any claim shall not exceed the transaction fee earned by SwapNaija on that specific trade.
